Statement From the Aruba Prosecutor’s Office regarding Natalee Holloway Investigation

Released 10/7/05.

From Aruba Public Prosecutor’s Office:

Investigation in Natalee Holloway case still ongoing

Oranjestad – The investigation into the disappearance of the American tourist Natalee Holloway is still ongoing. The investigation continues and the team is searching for new leads that may help solve this case. At the same time, the investigation that has been done until now is being revised and evaluated.

The Public Prosecutor’s Office is of the opinion that it’s important to bring the following forward with regards to how criminal investigations are conducted on the island of Aruba. The Public Prosecutor’s Office is an institute that has been established by law and the office forms part of the administration of justice and the judicial power on Aruba. The Public Prosecutor’s Office has specific tasks that are laid down in the laws of the island. One of the most important tasks, which is carried out by the Public Prosecutor’s Office as a part of the judicial power on Aruba, is the prosecution of criminal acts. The Public Prosecutor’s Office carries out this task by leading the criminal investigation that is done by the police. After the investigation is finished, the Public Prosecutor’s Office decides if a case will be brought before a judge through a citation.

In the prosecution of criminal acts, the Public Prosecutor’s Office operates completely independent from the Minister of Justice and the Government of Aruba. The Public Prosecutor’s Office does not have to justify its actions with regards to the prosecution of criminal acts to the Minister of Justice or the Government of Aruba. All the accounting that the Public Prosecutor’s Office has to do, will be done before the Common Court of Justice of the Netherlands Antilles and Aruba. Only the Common Court of Justice judges if the Public Prosecutor’s Office has done its work, the persecution of criminal acts, correctly. If that’s not the case, the Common Court of Justice can give the Public Prosecutor’s Office the necessary instructions. The Minister of Justice and the Government of Aruba do not have a say in this process. They cannot give instructions to the Public Prosecutor’s Office to prosecute somebody or to start a criminal investigation.

If a concerned party in a criminal case, for example somebody who has filed a complaint with the police, is of the opinion that the investigation is not being done or not being done in a reasonable amount of time, this person can file a complaint with the Common Court of Justice of the Netherlands Antilles and Aruba.

This statement from the Aruban ‘prosecutors’ is, sadly, not suprising. It is the typically arrogant, unsophisticated, insensitive and smug attitude that the Aruban government/legal system has shown since day one of Natalee Holloway’s disappearance.
      Aruba — no way!

    2. bizman on October 7th, 2005 8:18 pm

That is the law and how it works in Aruba. It is the way that the citizens of Aruba receive due process so it has to be the same process that anyone who visits their island receives due process.

So regardless of what your last name is it seems that this is the way that things are done across the board in Aruba.Under these laws everyone receives due process in due time. The most important thing is EVIDENCE will need to be produced when it is time for charges to be filed.

I would imagine that the prosecutor is handling more case than the Holloway case and Beth will just have to wait until due process is served. In the meantime she should print up some more of the HOOTIE posters that she originally had. Those first posters seem to reveal that Beth knows that Natalee possibly ran away and more than likely she has encountered disappearances from Natalee in the past. Why else would she have distributed posters like that in the first place and go on Aruban radio appealing for her to call her on her cell phone and Natalee’s cell phone as well.It is obvious that Natalee has a past that involves running away if only for a few days.

Let’s all hope that Natalee will be found and that she has run off and is alive and well doing whatever it is that she wants to do.

My, my, doesn’t this sound defensive? I guess someone in the Aruba government must be getting hot under the collar ….

Well, you can hide behind your legalisms … the cover-up in this case stinks to high heaven, and you and we know it.

Maybe a little more pressure will enable you people to get off your butts and put the liars and psychopaths back in jail ….

Seems like Aruba has had their fill of the Twittys.
Nice wording for “ya got a problem take it up stairs”. They seem quite confident that they have properly investigated this case. Nice to know they are continuing and going back…..looking at it from all angles.

They just keep on giving me reassurance on why my family and I will not be planning any vacations there. We love traveling to the caribbean. But won’t be going to where they only care about my money and not my family.

Is the Prosecution Office then accusing the Police Dept. of not delivering a correct, honest and thorough investigation? Passing the buck? No matter what, all this is a bundle of excuses, and cover ups.

    12. David B on October 8th, 2005 3:57 am

Basically Aruba can say that its okay to rape and kill women by not following through on this investigation. As an American and in support of Beth Holloway-Twitty please don’t give Aruba your hard earned dollars for travel. There’s lots of sand.

    13. NYSOM on October 8th, 2005 5:45 am

I am so tired of hearing how their system works, or how we Americans don’t understand how their system works. Whenever the media or Natalee’s family would comment – or yes complain, as they should – about how the investigation was being handled, the standard response was we don’t understand their judicial system. It became their standard response to a question they refused to address. We heard it in interviews from Aruban Attorneys, Aruban Media (not Josse) and we even heard it from Ruben Trappenberg the Gov spokesperson. Notice to Aruba, GUESS WHAT, WE GET IT!

But we don’t need to understand your system to know how an investigation is conducted, to know that the obvious suspects were free for 10 days to dispose of evidence while 2 clearly innocent men wasted in jail. SO NO MATTER how your system works or differs from ours, no matter whether we understand it or don’t, the bottom line is that the case was badly handled (an understatement in my opinion) if not completely botched as part of a conspiracy.

ONE LAST TIME, that is our complaint! Conduct the investigation, arrest, oh no, “detain” the correct suspects and give Natalee and her family justice. After months of frustration and grief, amidst repeated cries of disbelief that the suspects are allowed to walk free, even with the possibility of a boycott, I can’t believe you have the nerve or ineptness to lecture us once again on how your system works. Our complaints can’t be any clearer and will not be quieted by another droning civics lesson. ARUBA HAVE THE DECENCY TO BE QUIET OR STAND UP AND ADDRESS THE REAL ISSUES!

    14. mojo on October 8th, 2005 6:01 am

perhaps panic will lead to real action at last.

    15. iremember on October 8th, 2005 7:06 am

How depressing. Beneath the yards of legal and pr mumbo-jumbo, what I am reading is a statement that any boycott of Aruba cant possibly help advance the search for justice for Natalee, because the Public Prosecutor’s office answers only to the Court, not to the govt.

      NONSENSE!!!!
(edit) flows downhill, guys, and there is no legal system in the world immune from political pressure. Especially in a place so rife with cronyism and small town politics as Aruba.

While the statement may be technically and factually correct, the reality of Power on the Island is no different than anywhere else. Generate enough public dissatisfaction with the status quo and things will start to change.

    16. Prima on October 8th, 2005 7:10 am

    18. MadMan on October 8th, 2005 9:04 am

Don’t let “prima fool you with the adress. It’s either Oranjestad Aruba or Den haag Nederland not both. And Schedeldonks haven 100 is no adress in Aruba

    19. Frank on October 8th, 2005 9:16 am

This is another effort in buying more time on behalf of the Aruban govt. Talk is cheap, but results seem to be more difficult for this island. The prosecutor is of no use in this case. She has no power to do anything. Until this corrupt group of govt officials (including Palus) decides to make a move; nothing will be done in this case. We Americans will choose other places to vacation and the media adds that the Arubans are running will have little or no effect on how the Americans feel. This one is real easy; bring us Natalee and we will bring you tourists.

    20. icey on October 8th, 2005 9:22 am

Well Aruba and the ALE, enough with the thrid world speak, get down to business and get the case solved.

Figure out anyway possible to arrrest and charge the suspects with something, even spitting on the street or underage drinking or gambling and start locking people up!!!!

If ALE has a brain in there head they would take a look at how the Taylor Behl cas has proceed so far. The police were slow to get involved, but they locked up the prime suspects with whatever they could find right away.

This memo looks more like damage control and less like a call to action. Less talk ALE, MORE ACTION!!

Omit Oranjestad, Aruba from the address.
      The proper address is:

I checked the phone directory, because I live in The Hague and I have never heard of Schedeldockshaven. Please do not forget to use the zipcode 2511 EX, otherwise your mail might be lost.

Thank you Dutch for the correction. I got that information from a web site that was obviously incorrect.

Basically what they are saying – “we are going to do things the way we want and nobody can stop us. And, we don’t even care how incompetent and corrupt we look – because nobody can do anything to us. So, leave us alone.”

    24. sandy leiva on October 8th, 2005 2:09 pm

I think every concerned american should write to this justice dept and let them really know that we do not want this swept under the rug. We need to rally and show them we want a proper investigation, all files, records videos and forensic evidence to be reviewed along side with an FBI spokesperson so that they can not continue to sweep anything under the rug. We want justice, we want NH back one way or the other, We want the disgraceful attack upon BHT to end. WE WANT ACTION AND WE WANT IT NOW…………….. my letter just went out to them ……what are the rest of you going to do??????????????????????????????????????????????????????????????

    25. Lauralynn on October 8th, 2005 3:42 pm

First off, there has been continuous lies from the prosecutor’s office in Aruba. Remember that the current prosecutor in this case was not the original, but has been in position for the majority of the time. A quiz: the current prosecutor was assigned because; A) she is a niece of a high Dutch island official (hint this is true). B) she is totally incompetent C) she is an active member of the Van der Straaten/Van der Sloot conspiracy to keep the P.I.M.P.S. psychopaths from justice. OR D) All of the above. You can make your own answer but mine is D. Also we should remember that she is Aruba Dutch and by now we all realize what (edit) they are.

    26. Linda on October 8th, 2005 4:44 pm

I think it is time to let Aruba know that we know what happened and we know they covered it up, because of the friendship with Paulus Van Der Sloot. Now we have to show them that if they don’t expose him,
they will get no more money from the US visitors. Any recourse we have we will use.

    27. John Staton on October 8th, 2005 7:57 pm

An open question to the Officers of the Court, Kingdom of the Netherlands. Is Aruba where you send all of your losers? Do you send the Van der Sloots, Van der Straatens and that inept prosecutor, dirty cops etc to Aruba thinking ” how much damage can they do there?” Is that what you did, put all of your bad eggs into one basket? I certainly hope that the rest of your judicial system (World Court is in the Hage) is not this corrupt. As a child I knew many Dutch who came to the US following 1953 when much of your country became part of the North Sea. They were my friends and good people. I cannot relate them to what I see now. They were hard working Christain people in stark contrast to what is seen by my eyes at this point.

    30. Daniel on October 9th, 2005 7:51 am

Americans, please get a clue. They are very right to say that you don’t understand their system. And what’s worse, you don’t even seem to make an effort to understand it.

Now, what the prosecutor’s office (which is in charge of the Natalee Holloway investigation) is saying here is that you are barking up the wrong tree. They operate independently from the government (as they well should!). So, you can bicker about the Aruban government all you like but that won’t change a thing – its hands are tied. The prosecutor’s office only needs to answer to the Common Court of Justice of the Netherlands Antilles and Aruba. So if you are an interested party (in other words, if you are David Holloway or Beth Holloway-Twitty) and you have any complaints, you file them at the common court. The address is:

Gemeenschappelijk Hof van Justitie van de Nederlandse Antillen en Aruba
      Wilhelminaplein 4
      Willemstad, Curaà §ao, Netherlands Antilles
      Dutch Caribbean
      fax: +599-9-461-8341

Ignore the address of the Dutch justice department in The Hague, it has no jurisdiction in Aruba whatsoever.

    31. Richard on October 9th, 2005 9:43 am

Can’t the two security guards who were arrested under false pretences bring charges? Wouldn’t that provide the best of reasons to bring the van der Scums back to Aruba?

Or perhaps the two security guards know how things go in Aruba, and don’t dare ….

    32. E Saxxon on October 9th, 2005 8:42 pm

Really Max? Would that be before or after the prosecutor’s 4 weeks of vacation time in the last 3 months? Beth Twitty hasnt stopped Karen Janssen from doing her job. The prosecutor is lax and I think corrupt as well.

Amen Richard.. The first story Joran and the Kalpoe brothers gave was that they dropped Natalee off at the Holiday Inn, she fell and hit her head on a rock and 2 black security guards were approaching her.. That tells me all I need to know about those 3.. They could’ve just said they dropped her off at the Inn.. but they added she hit her head and the 2 black innocent security guards came over to her. They were trying to pin the crime on 2 innocent people.. They would probably still be locked up if Deepak hadn’t told one of the black security guards in prison, they lied, because Deepak didn’t know who the black security guard was.

They have said she looked and dressed like a slut.. she asked joran to dance..she asked him out for the night, it was her idea to do jello shots,,,she was a slut for getting in a car with 3 men?.. She’s an awful person for trusting that Joran would take her back to her hotel?

She had no idea what awaited her that night or I’m sure she would’ve went with her classmates..

God Bless Beth and her family for not letting the light go out on yet another missing American abroad.. and my heart goes out to the Aruban people also for what these 3 and their families have put their fellowmen through in that country..

As Deepak said on the tape they all 3 had sex with her that night..sure they were going to send her home after that and she would never talk about it.. next they will be saying they have a bridge for sale..

They should’ve been searched and taken in to be questioned separately the first night..not 10 days later..

The Twitty’s and Holloway’s life has been ruined and for what?? You never recover from losing a child..

While due process is being established there are possible rapists and killers on your streets of Auruba. Free to rape and kill one of your own. What if this was your child? America is jacked up and there are ignorant people in all parts of the world. This is not about the U.S VS. The Dutch minister of justice Ernest Hirsch Ballin says that he knows nothing about corruption on Aruba: how ridiculous and hypocrite he is!!!
Why did Hirsch Ballin then resign in 1994?
What does the IRT-affair with ramifications to Aruba mean?
Why did mr drs Frits Bolkestein have to entitle Aruba as a den of thieves?
Why did minister Alexander Pechtold and minister Rita Verdonk (cabinet Balkenende) silently go to Aruba?
With whom did they silently do business under the table?
Why did they silently leave Aruba without a press conference?

Because naturally nobody was to know that corrupt business matters was going on!

Why did the deputy prime minister Alexander Pechtold state that dirty business was going on at the Binnenhof?
Ernst Hirsch Ballin thinks that everybody forgot about the IRT-affair. E.H. Ballin must disappear for once and forever from the political arena; he knows quite well that he is incompetent.

The head of state, prime minister Balkenende and the Second Chamber of Parliament have already for a long time been informed about this practice of corruption, violations of human rights, oppression of the people and they then played dumb deaf and mute.
Why did Balkenende answer me on the 8th of may 2005 that I insulted him with my letter and that he renounced me? You can see at http://www.arubainjustice.com by documents the answers of them about my letters that I accused the gang of very corrupt people who operate on Aruba.

      BUT it is no WONDER.
Even Satan tries to make himself look like an angel of light. So why does it seem strange for Satan’s servants to pretend to do what is right? Someday they will get exactly what they deserve. And if the devil rises against the devil,… he fights against himself and destroys his own KINGDOM.

I cannot directly appear with all dates since 2005, because the corrupt Dutch police force of Netherlands have done a burglary in my house in order to seize my documents
under the false pretences that a man was indisposed in my house. But since 2003 I have secretly moved my documents, because I knew that these practices occur in the kingdom.
