Aruba Today: Kalpoe Lawyers; Tapes are Illegal and Falsified

From the September 17, 2005 Aruba Today, The Kalpow attorney state that not only are the tapes from the Dr. Phil show illegal that they are falsified as well. 17-09-2005 Aruba Today

According to Kalpoe’s Lawyer Rudi Oomen, the tape recording was not only illegally obtained, but edited in a way to make it appear that Deepak answered questions that were not originally asked. This interview clearly was a farce creating an allusion of guilt of the suspect for Dr. Phil’s viewers and guests.

However, the following couple of statements seem a bit far fetched as they occurred after the much publicized Beth Twitty confrontation with Deepak Kalpoe in the Internet Cafe. One would have thought after such a confrontation where Deepak claimed he was harassed and intimidated by Beth Twitty that his attorney, Rudi Oomen, would have told his client to talk to no one.

According to Oomen, Skeeters approached Kalpoe in July shortly after Beth Twitty herself had confronted Kalpoe in his place of employment. Twitty attempted to entice Kalpoe in person with a tempting $250,000 if he would just tell her that he “wasn’t involved in a sexual crime against her daughter …

Skeeters approached Kalpoe as a friend to help him combat the negative publicity that the family of Natalee continued to portray of him. Skeeters never told Deepak that he was being taped and he personally guaranteed that his conversations with him would be private.

One really does wonder why Deepak Kalpoe would have talked to anyone after the Beth Twitty confrontation and that his attorney would have advised him not to do so at all. Seems like there is a bit of controversy as to whether now Deepak admits he was being taped. Deepak’s attorney then goes on to say,

“It is obvious after viewing the Dr. Phil show, Skeeters had other intentions. The interview was fabricated by clearly a cut and paste procedure,”

One can also say the following, there is a difference between an fabrication and normal media editing. There is no such thing in the media as a non-edited story in print or video unless it is live. The other rather interesting quote of the article is the following, “After hearing the misleading false confession provided by Skeeter”. Misleading false confession? I think the question that comes to mind to any reasonable adult is why would there be a confession to anything if one was not guilty? Whether there was a camera present or not, a recording device or not; what difference would it make? If some one is innocent of something, do they really state otherwise if they don’t believe they are being recorded? This is the dilemma that the good people of Aruba face. Why are they supposed to believe Deepak was mislead into a confession by the American media when I am certain his attorney forbade him to talk to the media. How does someone confess to something that all along they stated otherwise? Do the people of Aruba who took time out of their lives to search for Natalee Holloway really believe that? Arubans may not like the style or form of the Dr. Phil Show or the reference of a boycott; however, to believe some of what Deepak’s attorney is saying is also difficult to believe. Deepak’s attorney concluded with the following statement:

Oomen concluded that his client could not afford to take legal recourse against Skeeter for his fabrication and defamation.

Interesting, seeing that they had n problems initially claiming that they were going to sue Beth Holloway Twitty for defamation when she made the reference that the suspects were criminals.

“She called our client, Mr. Satish Kalpoe, a ‘criminal,’ ‘involved in a violent crime against my daughter’ and who is ‘allowed to walk freely among the tourists and citizens…”

The good people have choices to make no matter what spin comes from either side. They may come about it from different angles Natalee’s parents, Beth Twitty and Dave Holloway are both after the same outcome. The where abouts of their daughter and justice for her. Make no mistake about it, they may have different approaches to the investigation; however, both believe that the three suspects know what happened to their daughter.

IF Deepak is innocent, isn’t there such a thing as an atty. sueing pro bono to restore HIS model citizen reputation ? HA !

    2. commonsense on September 22nd, 2005 12:03 pm

You ever try to find an attorney to work pro bono Stefani?? The interview that “proved that Deepak “Raped” Natalee” sure is a cut and paste job. Just more desperation from the Twitty family to take the truth and make it to their favor. They really make you want to cheer for the bad guys.

You did a great job of outlining all the gaps in the argument presented by Arubatruth, aka the Strategic Task Force.

Deepak don’t listen to your laywer, keep talking. You can put this behind you if you just tell us what happen.

      Commonsense,
this is not a personal attack, or at least not meant to be. Your postings have zero credibility. We can all try to read between the lines to try to piece something together to give strength to our own personal objectives. You come across as more and more calous every time you post. Let me simplify it for you. A young girl is missing. Her family has found three men that were with her the night she went missing. ALL OF them have lied to authorities. We still don’t have answers. This poor family needs closure. Now go ahead commonsense, spew more of your mouth garbage. Get all of the attention you seek. No wonder you hide behind a false name. You act as if you are one of these island club guys that drugs girls. And you are really angry because the gig is up and you cannot do it anymore. So you come on this GREAT site so vent your anger.

Aruba, what is wrong with you. You are letting the 2 Van Der Sloot’s and 2 Kalpoe brothers trash your Island. No American’s are going to vacation there until you find Natalee and put those 4 in jail. We will never stop until you find Natalee and do what you should.

What else is his lawyer going to say? Yeah Deepak is stupid and wants to go to prison? I think not!

The reasons listed in today’s Scared Monkeys article about Depak and the Skeeters tape, Depak’s lack of financial resources to fight this legally are identical to my own conclusions and thoughts. I sent an e-mail this morning to Aruba Today’s Editor in Chief after reading the online 9-17 edition of Aruba Today. Thank you!

another spin by the aruban lawyers and officials to keep up appearances of innocense by three punks who committed a crime. I guess since aruban lawyers dont deem it to be a crime its not. But then why did DK go on national tv and say those things. the transcripts are there as proof. Do they think people are so gullable to believe nothing happened. I quess if DK were to be guilty then they couldnt deny the other three are just as guilty, and Pap van der sloot would have to keep trying to claim innocense for these three and call in more favors. Come on people wake up , They did it what more proof is needed DK said it, read his lips……. he said and quite crassly they all had sex with her. get real the truth is so plain as the nose on your face…..

if the attorney really thinks he could win a lawsuit against beth, he’d offer to take the case for a percentage of what deepak received in compensation. the fact that he won’t take the case like that means he knows deepak doesn’t have a chance to win. lawyers, you got to love them.

    14. Stefani on September 22nd, 2005 10:53 pm

More lies, but this entire situation has been FULL of untruths on Aruba’s behalf ! Is anyone in Arubian LE taking a good HARD LQQK at Mr. Michael Posner, from the EXCELSIOR ? Seems to me they should, especially IF he is also gone, and had former maffia ties. Seems like a good candidate to get ANYTHING done ANYBODY would want !

    15. Stefani on September 22nd, 2005 10:57 pm

AGAIN, may I suggest that Deepak locate an atty. to handle a defamation of character suit against Beth and Dr. Phil and 90% of the USA !IF he did NOT make the tape and is INNOCENT, then by all means he should be willing to prove it to the world. I bet Dr. Phil would bring him to the USA ~ 1st class for a lie detector test by Skeeters !

I am more than upset that the three criminals, Joran Van Der Sloot and the Kalpoe brothers are free. All three admitted to have raped Natalee, who was drugged by them.
That in itself is a crime and they have not been charged. It is so obvious that the three of them are responsible for her disappearance. The Aruban police and Joran’s father are probably involved in the cover up. The whole act is very barbaric!!!

    20. Gary on September 23rd, 2005 4:22 pm

The Deepak’d Dr. Phil interview eliminated any doubt that ALL three of the suspects raped Natalee. Both Joran and Deepak have now admitted to having sex with Natalee while she was very intoxicated and going in-and-out of consciousness. From a common sense perspective, it amounts to an admission of being guilty of rape. Legally, it is probably not enough to get a conviction because there is no victim and no collaberating evidence: however, it does eliminate any uncertainty as far as the public perception is concerned.

All we can do is pray that Natalee’s body is someday found.

    21. cheryl on September 23rd, 2005 4:52 pm

you may not want to face the truth but the FACT still remains NO BODY NO CASE i think it sucks big time but nothing can and will be done until they find the proof that these 3 boys did in fact have something to do with NH disappearance until then these boys are innocent . Deepak can say whatever he wants, it is still a free country and he will not go to jail for that he knows that i know that and eveybody knows that.in 3 months nothing was found not 1 thing was found to put guilt on these 3 boys so i hope every one steps back for maybe a day and wonder who the people are really upset with because the last i heard its now called a cold case.

    22. Linda on September 25th, 2005 6:02 am

Cheryl: You are mistaken. Its not true NO BODY NO CASE. Obviously it will make it harder to prove…but its been done before. Yes its still a free country. Having said that…don’t be so sure that they won’t go to jail. We don’t ALL know that as you state. What is happening in Aruba is shameful. They have at a minimum admitted to raping Natalee. Whether or not they can prove they killed her…whether by accident or intentionally…we don’t know, however even at that…they have admitted there was a body at different times. As for who we are really upset about? I can only answer for myself. I am first upset at parents who would allow a 17 or 18 year old boy to be out on a school nite…who apparently allowed their son to bring a girl to their home in the early morning hours…and then go back out again. Who when they found out their son was involved…whether innocently or not…would coach the 3 boys rather than take them in to try and help the police find out what happened to Natalee.

Next I am upset with the boys themselves. Had they not been guilty…why lie so many times???

You say not 1 thing was found to put guilt on these 3 boys. First of all…plenty has been found to put guilt on at least 2 of them. Secondly…not you nor I know what evidence they have on them…so don’t assume nothing has been found. I work in a law office. As I said…because the body has not been found yet…that means they will need to build a much stronger case. If they prosecute and lose…they will not be able to prosecute a second time. At any rate that is the law in this country…unsure about Aruba.

As for Deepak being able to say whatever he wants…yes he can. However…if he is called onto a witness stand he will have two choices. He can say he was lying when he made the statements…which when asked why he would do that…I for one would be interested to know that answer. Or he can say he was telling the truth. He just set himself up big time if and when a trial is held…and I have to believe a trial will be held.

As for commonsense’s comment about trying to get an attorney to handle the case pro bono. With a case with this much media coverage…you’d better believe there would be attorneys knocking down his door to handle his case if they believed him. Deepak has proven himself to be a “loose cannon” as a client. I’m quite sure his attorney is freaking out at the moment. One reason an attorney would handle a case pro bono is the anticipation of a large dollar payoff at the end. With Dr. Phil involved…if he felt he could win the case…there would be big $$. The other reason they might take a pro bono case would be the media and how if they won it would forward their career. Obviously…they know neither of those will happen.

These boys are guilty. Whether or the actual crime…or whether its knowledge of a crime I don’t know. None of us do until there is a trial. But have one question for commonsense. Why in the world would you think her family is attempting to twist the truth and cut and paste?? She isn’t looking to be in the spotlight…she needs answers as to what happened to her daughter. She has seen a lot more proof than any of us has seen…has spoken first hand to people. I think she is handling herself and the situation amazingly. She is a classy strong woman…and I doubt I could be as strong as her in the same situation…and doubt that you could either if it was your daughter. Give her some credit…whether you think they are guilty or not huh?
